Court stops developer from evicting College of Insurance in South C

In a ruling issued by Milimani Environment and Land Court Judge Grace Kemei, the developer was ordered to immediately stop constructing a perimeter wall that was cutting off five acres of the College of Insurance’s playground.
“That the application be and is hereby certified urgent. That in the interim, prayers No three and four of the application be and are hereby granted pending the inter partes hearing,” ruled Justice Kemei.
The College of Insurance, which also operates the Edge Convention Center, has been battling multiple land grab attempts for over 20 years.
Justice Kemei also warned that any disobedience or non-compliance with the court order would result in penal consequences.
In its petition, the institution asked the court to suspend an earlier order issued in November 2024 in a miscellaneous application that had granted the developer possession rights to the contested land, reference number 209/10210.
The college argued that it has been in exclusive possession of the property since 1994, using it as a sports ground and parking area for its guests.
Following the court order, the institution, through its lawyer Kenvine Odhiambo, wrote to Mr Karume’s legal team of Ahmednasir Abdullahi and Peter Muchoki notifying them of the court’s directive.
“We write to inform you that the Environment and Land Court (Hon Lady Justice Grace Kemei) has issued an order directing your client and his auctioneer, agents or any person acting through him to forthwith stop eviction of our client, take possession of, or in any way remain in possession Land Reference No. 209/10210, pending the hearing of our client’s application on June 16, 2025,” the letter, seen by the Nation, reads.
This development comes after a violent confrontation last week when armed goons stormed the institution injuring two staff members and causing damage to school property. One of the main gates was reportedly brought down and stolen.
The management also claims that the construction of the perimeter wall has interfered with the school’s sewer line resulting in discomfort for guests and staff.
